Welcome to Vary Projects. By working with us, visiting our website, or signing a service agreement, you agree to the following terms and conditions. These terms are designed to clearly outline responsibilities, expectations, and the scope of our engagement. Please review them carefully.
1. Services Provided
Vary Projects delivers commercial and retail shopfitting services across Brisbane and the Gold Coast. Our work includes concept design, manufacturing, fit-outs, project management, and associated trade coordination.
The exact scope, deliverables, and timelines will be detailed in a formal proposal or contract agreed to by both parties.
2. Client Responsibilities
Clients must:
Provide accurate project requirements, site details, and any relevant documentation.
Respond promptly to approvals, variations, material selections, or requested information.
Obtain all required permissions, permits, building approvals, and compliance documentation unless otherwise agreed in writing.
3. Fees and Payment
All fees will be outlined in a written proposal or contract.
Payments must be made according to the agreed schedule (including deposits, progress payments, and final invoices).
Late payments may incur interest or delays in project delivery.
All fees are non-refundable unless otherwise specified in the agreement.
4. Intellectual Property
Vary Projects retains ownership and copyright over all designs, drawings, plans, and related materials we produce.
Clients receive a non-transferable license to use these materials solely for the approved project.
Replication, distribution, or modification of our work without written permission is strictly prohibited.
5. Confidentiality
Both parties agree to keep commercially sensitive and project-related information confidential.
Vary Projects reserves the right to showcase completed projects—images, videos, or case studies—unless the client requests non-disclosure in writing prior to commencement.
6. Project Timeline
Timelines are outlined in the contract and may shift based on supply chain conditions, site access, weather, or other external factors.
Delays caused by the client, third parties, or unforeseen circumstances may result in timeline adjustments or additional costs.
7. Liability
Vary Projects is not liable for delays, damages, or additional costs arising from:
Material shortages
Supplier or subcontractor issues
Council or regulatory changes
Structural site conditions not disclosed or visible prior
Force majeure or events outside our control
Disputes will be handled in good faith and, where necessary, through mediation prior to any legal steps.
8. Variations, Amendments & Revisions
Any change to the original scope—including material changes, design alterations, or additional works—will be treated as a variation and will incur additional fees.
All variations must be approved in writing before work proceeds.
Revisions must be requested within the timelines stated in the contract.
9. Termination
Either party may terminate the contract with written notice under the terms outlined in the agreement.
Termination fees may apply to cover completed work, materials ordered, labour, and any other costs incurred up to the date of termination.
10. Warranties
Vary Projects warrants that all work will be delivered with professional skill, care, and industry-standard workmanship.
No additional guarantees apply unless explicitly stated in writing.
11. Governing Law
These terms are governed by the laws of Queensland, Australia.
Any disputes will fall under the exclusive jurisdiction of the courts located in Brisbane or the Gold Coast.
12. Updates to These Terms
Vary Projects may update these terms at any time.
Clients will be notified of any significant changes prior to implementation.
